Rights and Obligations
When you sign into a Training Contract with your apprentice or trainee, this is a legally binding contract. Kangan Institute recommends that you follow the National Code of Good Practice for Australian Apprenticeships and Traineeships to understand your role and responsibilities as an employer.
The National Code of Good Practice along with the guidelines as set by the Training Contract, relevant Industry bodies and the VRQA can assist in setting good practice in the workplace and assist you to:
Meet legal obligations
Provide a safe and inclusive workplace
Support your apprentice or trainee with their structured training
Provide supervision and support
Advise apprentices and trainees of their rights and responsibilities
Apprentices and trainees also have roles and responsibilities; they must maintain an understanding of and commitment to workplace responsibilities including:
Attending and performing work in a professional and respectful way
Take care of workplace property and resources.
Be aware of and comply with workplace policies and procedures.
Maintaining any relevant workplace registrations, licences and certificates.
Taking care of personal health and safety and that of others who may be affected by the actions of the apprentice or trainee.
Behaving in a way that is inclusive and respectful.
Understand that some information gained through work may be confidential and can’t be shared without employer approval.
Being aware of entitlements such as pay and conditions that apply both in the workplace and while undertaking TAFE
Understanding that certain workplace or training activities may require the consent of a parent or guardian if the apprentice or trainee is less than 18 years of age.
